YOSOMIND LLC - TERMS OF SERVICE

 

Section 1 - Scope of the Agreement and Company Identity 

These Terms of Service ("Terms") define the rules of use for the Yosomind Platform and all related digital services offered by Yosomind LLC ("Company"), headquartered in Wyoming, USA. Our platform infrastructure is provided by Shopify, our payment system by Stripe, and our membership management by Simplee Membership. By using the platform and creating an account, you fully accept these Terms.

Section 2 - Service Tiers and Product Scopes 

The Yosomind Platform offers membership models with varying access privileges and additional services to its users:

• Yosomind Flex: Grants access to the digital education archive on the Vimeo infrastructure and regular live classes/workshops for the duration of the active membership. Academy educational contents are situated completely outside the scope of this package.

• Yosomind Academy: In addition to all the rights in the Flex package, it provides full access to instructor trainings and deepening contents.

• Kökler Membership: This is the highest tier of the Yosomind Academy, and its total capacity is limited to 50 people. Once the quota is filled, new member admission is halted, and the company fully reserves the right to protect this limit and unconditionally terminate membership acceptance when necessary.

• One-on-One Consultation Sessions: Encompasses personalized online meetings and somatic practice sessions scheduled by users directly with authorized instructors.

• Downloadable Digital Products (PDFs, etc.): Written or visual digital documents purchased as a one-time transaction via the Yosomind Platform, granting the user the authority to host and review them on their own device.

Section 3 - Medical Disclaimer 

All services (nervous system regulation contents, somatic practices, live workshops, and one-on-one consultations) offered via the Yosomind Platform are strictly for educational, guidance, and personal awareness purposes. These services are positioned entirely outside the fields of professional medical diagnosis, psychiatric treatment, or medical intervention. Users personally assume responsibility for the effects of the provided practices on their own bodies and minds. The Company is completely exempt from all legal liabilities for any potential physical or psychological outcomes that may arise.

Section 4 - Billing and Auto-Renewal (Recurring Billing) 

Monthly, 6-month, and annual prepaid subscriptions initiated through the Simplee Membership system are automatically renewed in accordance with the selected period at the end of the billing cycle. Upon initiating a subscription, users grant permission for their card information to be securely processed and for recurring payments to be collected via the Stripe payment infrastructure. To stop the renewal process, it is mandatory for the member to personally complete the cancellation request through the system at least 24 hours prior to the billing date.

Section 5 - Digital Product Delivery and Service Commencement 

The delivery of all services and memberships purchased on the Yosomind Platform occurs entirely in a digital environment. The legal moments of delivery, based on the purchased product, are as follows:

• For Memberships: The exact moment the user performs the "Initial Log-in" to the Yosomind Platform using their designated email and password.

• For Downloadable Digital Products (PDFs): The exact moment the provided download link is clicked or the file is saved to the respective device.

• For One-on-One Consultation Sessions: The exact moment the reservation time is finalized and the online participation link (Zoom, etc.) is officially delivered to the user.

Section 6 - Intellectual Property, Account Security, and License Limits 

Video recordings, PDF documents, written materials, and live class broadcasts purchased via the Yosomind Platform are protected by US and international copyright laws. Purchased memberships and digital products (PDFs) present a strictly personalized use license to the user. Sharing account information (username and password) with third parties (Account Sharing), as well as the unauthorized reproduction, copying, exhibition on public platforms, or distribution of PDFs and other documents for commercial/free purposes, constitutes a strict rule violation. Upon detecting such circumstances, the Company reserves the right to permanently delete the account without any refund and initiate legal proceedings for financial compensation.

Section 7 - Governing Law and Jurisdiction 

These Terms and all commercial relations between the parties are governed by the laws of the State of Wyoming, United States of America. In any legal dispute that may arise, the authorized and competent judicial authority is strictly the Courts of the State of Wyoming.
